According to NBC Sports Cowboys owner Jerry Jones will testify in court for the second consecutive month.
This time Jones will make an effort to prove that Alexandra Davis and her mother, Cynthia Davis, violated a 1998 agreement on the paternity issue beginning the week of July 22.
Despite the fact that the arrangement seemed to have been handled by someone else, Jones will nonetheless testify.
There has been speculation that Jones’s attorney had intended to provide evidence without having him testify. However, the defense attorneys for the defendants have subpoenaed Jones to appear and testify, perhaps because of this very reason.
Just because he’s willing to take the oath and answer questions doesn’t imply they’ll all be addressed. It’s possible that Jones’s attorney is prepared to raise objections to anything beyond the simple request, “State your name.”
This really all comes down to whether there was a breach of contract. His burden of proof is twofold: first, that a contract existed; and second, that someone broke the terms of that contract.
Alexandra Davis sued Jones and others for defamation following her initial case to establish paternity. The lawsuit was based on comments spoken about her after the initial litigation. Jones filed his breach of contract action as a counterclaim. The defamation action has been dismissed, but the opportunity to appeal remains open. In the meantime, we will have to wait for the decision from the appeal court in the paternity case before we can find out whether Jones will agree to a DNA test.
